Every State I've worked in to pass legislation has a personal story behind it. Some can lead with their powerful testimonies, while others prefer to remain behind the scenes as we work. We defer to the expertise of the legislators to ultimately decide the bill language as they know what they can pass.
In 2019, Texas passed (SB 1259) a criminal cause of action against illicit inseminations.
During the 2021 legislature, SB1895 was passed adding a two year discovery rule to the Texas Medical Board statue of limitations for doctor daddy cases.
In 2023, Illinois passed (SB 1467) a civil cause of action against illicit inseminations.
Victims are entitled to compensatory and punitive damages or liquidated damages in the amount of $50,000, in addition to attorneys fees. Children are entitled to the medical records and health history of the person who committed the fraud. The is an income tax exemption for damages received, and there's a long statute of limitations. It is the first law that is retroactive!
